(“Cymonix,” “CymonixIQ+” “we,” “us” or “our”) collects, uses and shares the information of persons and companies (“user,” “you” or “your”) that access, download from or otherwise use our website at www.cymonix.com (the “Website”) or any of our software and related services and documentation (the “Software”).
When you access or use our Website or Software, you acknowledge that you have read and understand this Privacy Policy. Your use of our Website and the Software is subject to this Privacy Policy and the Cymonix Terms of Use (including any applicable limitations on damages and the resolution of disputes). We may update this Privacy Policy at any time as we deem appropriate. You periodically should check back and make sure that you have reviewed the most current version of the Cymonix Privacy Policy.
This Privacy Policy applies to all users of our Website and Software anywhere in the world. Some users, including residents of the European Union/European Economic Area, may have additional rights depending on where they are located, which are described in this Privacy Policy.
- INFORMATION WE COLLECT. We collect some information that you provide directly to us and some that we collect automatically. “Personal Information” refers to data that could be used, alone or in combination with other data, to identify you as an individual. For example, we may collect information when you purchase a product or service, create an account, fill out a form, request customer service, or otherwise communicate with us. The types of Personal Information you may provide include contact information (such as name, email address, mailing address, and phone number), payment information (such as billing address and bank account information), account log-in credentials (such as user names), and usage information (such as the user’s internet service provider, type of web browser and operating system, IP address, viewed pages, and time and duration of site visits. We use this information to assess how users access and use the Website and Software, to improve the Website’s and Software’s functionality and to contact you regarding the Software and our services. In addition, we automatically collect information about your interactions with the Website and the Software, as well as the devices that you are using to access, download or use the Website and Software, as follows: (a) CAPCHA. We use the reCAPTCHA service provided by Google Inc. (“Google”) to protect your information that you submit via submission forms on the Website. This plugin checks if you are a person in order to prevent certain Website functions from being used by spam bots. This plugin query includes the sending of the IP address and possibly other data required by Google for the Google reCAPTCHA service. For this purpose your input will be communicated to and used by Google. However, your IP address is previously truncated by Google within member states of the European Union or in other states which are party to the agreement on the European Economic Area and is, as such, anonymized. Only in exceptional cases is a full IP address transmitted to a Google server in the United States and truncated there. On behalf of Cymonix, Google will use this information to evaluate your use of the Website. The IP address provided by reCaptcha from your browser shall not be merged with any other data from Google. This data collection is subject to the data protection regulations of Google. For more information about Google’s privacy policy, please read the Google privacy policy. By using the reCAPTCHA service, you consent to the processing of data about you by Google in the manner and for the purposes set out above. (b) CymonixIQ+ SANDBOX. The CymonixIQ+ Sandbox collects usage statistics and maintains an audit log as part of its regular operations. We collect queries executed in the Sandbox environment and the IP addresses of the user to identify unique Sandbox users. We do not collect any personal identifiable information. We use the collected information to ensure continuous operation of the Sandbox environment and debug issues in the event of errors and failures. (c) Hubspot. We use your data stored in HubSpot to communicate with you, provide relevant information about our products and services, and tailor our offerings to your preferences. We may also use your data for analytics and marketing purposes to enhance our services and user experience. (d) WIX. The data collected through Wix Chat is used to communicate with you, provide assistance, and offer relevant information about our products and services. We may also use this data for analysis and improving our customer support and user experience.
- NO SHARING OF YOUR INFORMATION. We never share any Personal Information with any organization, partner or other party outside of Cymonix, except as follows: (a) with partners with whom we conduct cooperative, joint events (typically a webinar), but only if you elect to sign up for and/or attend an event cosponsored by us and a partner; (b) with legal, governmental, or judicial authorities as instructed or required by those authorities and applicable laws, or in relation to any alleged illicit or illegal activity, such as in response to a subpoena or investigation of suspected illicit or illegal activities, or where we believe in good faith that users may be engaged in illicit or illegal activities, or where we are bound by contract or law to enable a customer or business partner to comply with applicable laws; (c) in connection with, or during negotiations for, an acquisition, merger, asset sale, or other similar business transfer that involves all or substantially all of our assets or functions where Personal Information is transferred or shared as part of the business assets (provided that such party agrees to use or disclose such Personal Information consistent with this Privacy Policy or obtains your consent for other uses or disclosures); (d) with your consent or at your direction, such as when you choose to share information or publicly post content and reviews (for example, social media posts); and (e) with persons of your choosing and at your discretion, should the Website or the Software allow that functionality. We may also share aggregate data that does not identify you or any specific device with third parties.
- PROTECTION OF YOUR PERSONAL INFORMATION. We use administrative, organizational, technical and physical safeguards to protect the Personal Information we collect and process. Our security controls are designed to maintain data confidentiality, integrity and an appropriate level of availability.

We will keep your Personal Information for the minimum period necessary for the purposes set out in this Privacy Policy, namely (i) for as long as you are a registered subscriber or user of our Website, Software and related services, (ii) for as long as your Personal Information is necessary in connection with the lawful purposes set out in this Privacy Policy, for which we have a valid legal basis, or (iii) for as long as is reasonably necessary for business purposes related to provision of the Website, Software and related services, such as internal reporting and reconciliation purposes, warranties or to provide you with feedback or information you might request. In addition, if any relevant legal claims are brought, we may continue to process your Personal Information for such additional periods as are necessary in connection with that claim. Once the abovementioned periods, each to the extent applicable, have concluded, the applicable Personal Information will be either permanently deleted, destroyed or de-identified so that it can no longer reasonably be tied to you.
- DATA TRANSFERS. We are headquartered in the United States and have operations and provide services in the United States and throughout the world. You may contact us to submit a request to exercise your rights in Personal Information. If you initially consented to our processing of your Personal Information, you may contact us to withdraw your consent. If you are an EU/EEA Data Subject and have a concern about our practices concerning the processing of Personal Information that we are not able to resolve, you have the right to lodge a complaint with the data protection authority where you reside, in which you work or in which the alleged infringement occurred.
